Oliver Hyams appears in Supreme Court employment status case
Oliver Hyams has just appeared in the Supreme Court, in a case concerning the employment status of a minister of religion: Preston v President of the Methodist Conference. Oliver was the sole advocate for the claimed employer in the Employment Appeal Tribunal and the Court of Appeal, but he was led in the Supreme Court by Dinah Rose QC.
The case which concerned the question whether Methodist ministers are employees gave rise to a number of significant issues for the law of employment, such as if the test for deciding whether or not to imply a contract is applicable when determining if the parties intended to enter into contractual relations. The Supreme Court’s judgment is awaited.
