High Court approves multi-million settlement for brain-injured young man
On 18th January 2016 Mrs Justice Thirlwall approved a settlement with a capital value of £5.89M for a brain-injured young man.
At the age of 10, the Claimant - to be referred to as AB XY - suffered a catastrophic brain injury in 2004 when he was a pillion passenger on a motorcycle ridden by his father who tragically died in the accident. Despite making a reasonable physical recovery, the claimant continues to demonstrate intellectual difficulties as well as physical strength aggression, resulting in the need for careful handling in the community. Although supervision does not need to be constant, the reality is that he requires care from skilled professionals around the clock, seven days a week. The settlement offers this for life with no discount for risks of untoward incidents suspending the need for care.
Under the settlement, AB XY will receive a lump-sum of £1.9M together with periodical payments of £130,000 every year for life.
