JX MX wins “Outstanding Case of the Year” at the PI Awards 2015
The Eclipse Proclaim Personal Injury Awards 2015 recognised the input of all representatives for the claimant and the Personal Injury Bar Association for their involvement in JX MX v Dartford & Gravesham NHS Trust [2015] 1 WLR 3647 which scooped the ‘Outstanding Case of the Year’ Award on 26th November 2015. One of the criteria the award was judged on was setting an industry wide precedent in challenging circumstances.
Robert Weir QC, instructed by Colemans-Ctts for PIBA, led William Latimer-Sayer from Cloisters in this ground breaking case.
In JX MX the Court of Appeal reversed the general rule that the name of the claimant should be made public in approval hearings as in all other hearings. The position now for all approval hearings is that there is a presumption in favour of anonymity of the claimant. The judge should invite submissions from the parties and any members of the Press attending before making an anonymity order but should make such an order, unless satisfied that it is not necessary to do so.
