Pivotal telecommunications case reaches the Court of Appeal
This week has seen the hearing of one of the most important telecoms cases to reach the Courts in the last three years. All of the UK’s major telecoms companies were before the Court of Appeal for a four day hearing about the meaning of the EU Common Regulatory Framework and the Communications Act 2003. The issues were focused on Ofcom’s powers under, and approach to, the prescribed dispute resolution and price control mechanisms and arose out of a dispute between BT, Sky, TalkTalk, Vodafone, Verizon and Virgin media over BT’s cost orientation obligations. Repayments well in excess of £250,000,000 are at stake.
