Robert Weir QC establishes duty of care in novel situation for asbestos victim
Robert Weir QC acted for Mr Chandler in Chandler v Cape plc [2011] EWHC 951 who developed asbestosis illness as a result of exposure to asbestos at work from 1959 to 1962. Cape plc was not the claimant's employer but rather the parent company of his employer. The sole issue for the judge was whether the parent company owed a duty of care to an employee of its subsidiary company. This is the first case to hold that such a duty of care does exist.
