Robert Weir QC is acting for a mother who lost out on compensation when her partner was killed at work because they had only been together 18 months. The Claimant was seven months pregnant and on the verge of moving into a new home when her partner was fatally injured at work.
Robert Weir QC is seeking a declaration of incompatibility in the High Court in respect of the rule in the Fatal Accidents Act 1976 which prevents cohabitants of less than 2 years from claiming damages for loss of dependency. The hearing is continuing before Eady J.
