Robert Weir QC wins Rome II case in Court of Appeal
Robert Weir QC acts for Mr Wall, who was rendered tetraplegic in an accident in France. In Wall v Mutuelle de Poitiers Assurances [2014] EWCA Civ 138, the Court of Appeal dismissed the defendant’s appeal against the decision that the issue of the instruction of appropriate quantum experts was governed by English law. This was the first time the Court of Appeal has had to address the ambit of Rome II, the European Regulation which determines the applicable law for non-contractual obligations.
