Tetraplegic claimant lives rent free in home purchased by insurer as part of settlement
Rob Weir QC acted for an elderly gentleman, rendered tetraplegic in a road traffic accident the fault of the defendant. The insurer, RSA, agreed to fund 6 months in the Royal Bucks hospital whilst it purchased and adapted a bungalow. As part of the settlement, the claimant entered into a tenancy for life on a peppercorn rent; furthermore, his wife is entitled to continue to live in the property rent-free for the remainder of her life, should the claimant pre-decease her. RSA, the defence insurer, paid £1m by way of lump sum and met the full cost of the claimant’s care regime, over £386,000 p.a., by way of a PPO. On this basis that the claimant entered into an active reverse indemnity.
